Although we may not agree with some of the content, we are happy to announce the addition of the following blog sites "Sonoranalliance" and "the Scottsdale Citizen" to the Scottsdale Activist for those who enjoy the blogging experience. Because of a short week and many family responsibilities and happenings, this edition will be rather short. Next week will have more material in the editorial section. ~ "Epicenter": the New Scourge Up North The Scottsdale Tribune ran the following story on the new non-code conforming "Epicenter" project at SR-101 and Bell Road. http://www.eastvalleytribune.com/story/131437 It appears that yet again another developer is throwing his weight around by trying to destroy or circumvent the current ordinances and laws imposed on city development by the citizens of the city. All of this with the eager help of the city staff and inept Planning Commission who should ALL be answerable to the citizens or removed all together. What does it take for city staff, the Planning Commission and the DRB to LISTEN to the citizens? What about the safety factor concerning the aircraft flying into, out of, or over the top of Scottsdale Airport? Isn’t height a major safety factor here? Has anyone in the city Planning Department asked the FAA for a formal opinion on the development? Big money says they haven’t and I’d bet not too!! Why are we even allowing a discussion let alone a decision on this project until after the Airpark Development Plan has been completed and publicly approved? Again, we have the cart before the horse which is apparently being driven by none other than the "Frick and Frack" of the city code demolition crew rather than people who are answerable to the citizens and have a real interest in maintaining the historic and safety values of the city while allowing development that fits the current codes and safety concerns. We all know the Planning Department very understaffed and is in deep trouble, but this is ridiculous!! It would appear that the City Council should remove any and all Board, Commission or Committee persons involved that also have related businesses in Scottsdale or work on projects within the city limits. That would apply to city employees as well. ~ Self-Centered and Ungrateful? In the Season of Giving, I have a complaint. While we are definitely in an economic crunch in every city in this country, why is the general public preoccupied with bargain shopping and watching who gets paid what and how much? We are loosing perspective! To all of those stores – grocery stores, discount stores, department stores, etc. don’t start promoting your businesses as super patriotic because you are not and all of the enablers who shop on specific national holidays like Thanksgiving, Fourth of July, Veterans Day Memorial Day and Labor Day – Shame on you!!!!!!!!!!!!!! Don’t start telling anybody that are not true Americans or disrespectful of our "Fore Fathers, founders of our country," or disrespectful of the Constitution or the Bill of Rights or the Declaration of Independence. Shopping, shopping, shopping and more shopping is all a majority of the United States citizens think about and want preserved. The Rights to Shop and Sell have become more important than any of the Civil Rights we have fought and died for since the Pilgrims landed. On top of all of that we have more people willing to fight over a bargain at Wal-Mart (or many other retailers) than they are to serve their country in conflict. Some are more willing to spend money on building walls with gates around their neighborhoods than they are to spending dollars on the safety of the policemen, firemen and military personnel who keep our country safe. Then when it comes to thanking those who serve, they think a quick recitation of the Pledge of Allegiance should do it as they dash for the sales at the nearest store. These same people seem to think that the word "free" in the phrase "Free Market" means no payment involved. NOT NOW!!!!!!!!!! NEVER HAS BEEN!!!!!!!!! The payment requires integrity, responsibility and accountability, and consequences if you mess up the first three. So far there have been a lot of "mess ups" and they have to be fixed. If you are one who is opposed to paying your taxes to fix the roads, dams, bridges, railroad tracks, the airports, and all of the other things that build a strong foundation for the cities this country to continue to build upon, please take the above mentioned holidays off and volunteer a days time to serve the city, the neighborhood, the country. It is really very easy to do and a very small offering and use of your precious time for being fortunate enough to be living and prospering in the city of Scottsdale and the United States of America. As we begin to celebrate Christmas, please remember
those who fight to keep us free, so that we are Free to celebrate the
birth of Christ without fear of anyone or any one government. It is not

LCDR Jeff Giles, SC, USN 30th Naval Construction Regiment OIC, Logistics Cell One Al Taqqadum, Iraq ~ Letters to the Editor letters@scottsdaleactivist.com Editors Note: To preface this letter to Raun Keagy, General Manager of Neighborhood Services, from an obviously and rightfully upset Scottsdale citizen, we need to make it clear that I sat down with Assistant City Manager David Ellison and General Manager Raun Keagy. A number of issues were discussed which will hopefully help improve the workings and public perception of the department. Both Ellison and Keagy were open to suggestions and understood the problems we discussed. I must say though that I agree, in my and many other citizens opinions, that Mr. Hankins as Field Manager as well as a few of his employees are not doing the job that is commensurate with the proper customer service and level of expertise required of Scottsdale city employees. By his actions, Malcolm Hankins is apparently in disagreement with the well proven and widely accepted concept that personal contact is the most important part of customer service when in the position of enforcing codes, ordinances and laws for the position currently held by Mr. Hankins. I also agree that there are some employees who only do the minimum they need to do, but don’t step out of the box to go above and beyond the job description to make the city a better place to work and live. We understand that the department is currently under serious reassessment and reorganization and in all fairness we ask that Keagy be given the chance to do what’s necessary to correct the deficiencies currently obvious within the department within a reasonable period of time. Everyone should be reminded that the department policy was dictated to former General Manager Judy Register by former City Manager Jan Dolan with Mayor Manross’ approval for almost 7 years and those numerous and necessary corrections cannot be made over night. We would also strongly suggest that Mr. Rivero-Lowen make an appointment with Acting City Manager John Little to discuss, with factual information in hand, his problems with the Code Enforcement Department and any other issues or departments he may find necessary to discuss. Editor Mr. Keagy: I am in receipt of your email suggesting that my services were 'no longer (welcome) at the Code Enforcement Department'. First, that is clearly too bad. The initial mandate to help a dysfunctional department and manager were compelling. There is no question that this department is in chaos and is barely functioning under the inept, incompetent Manager, Malcolm Hankins. Once again, as I detailed in previous emails there are many infractions, most obvious and all serious that are constantly ignored, although numbers of reports to address these have been filed. More egregious is the fact that you have decided, obviously on your own account, to 'empire build' as Neighborhoods Department Manager. You made a decision to move me out because I became the 'conscience' that you cannot cope with and get away with not doing your job. Your job is to see that violations are dealt with and subordinates do their job. Neither of which you do. You are every bit as incompetent as Mr. Hankins. Your choice to spend consider amounts of Taxpayer dollars, at a time of deepening city deficits, on pool equipment to resolve 'algae issues', when The County had a mandate to do this is an example of your poor judgment. Further, you have never answered questions of possible undue influence by special interest groups in Scottsdale. For example, The American Church, at Pima and Dynamite has extensive roadwork and sign work done to aid this church. For the fifth time I want to know who paid for this? Did you or anyone else authorize city funding for a private enterprise? You indicated once, under pressure that they would 'pay it back'. What does that mean? I also asked about a wall that had been built directly on a wash between E. Desert Cove and Becker, bordering 96th Street. This is illegal, yet, again you chose to ignore this. Why was this allowed and what was/is your response? Some time ago I began to accumulate a digital record of illegal signage, vehicles (review my report of an 18 wheel truck with Monterrey Homes signs at the corner of Westland and Scottsdale Roads-there for 11 months), et al. You suggested that you would get Mr. Hankins to 'better do his job'. This never happened, and the public areas show more instances of intrusion. Frankly, it can only be a matter of your incompetence, malfeasance and simply pandering to wishes of the present Mayor, and possibly members of The Council, that you not rock the boat of special interests. I will, at this time, advise The City Attorney of my wish that you be removed 'for cause', and the same for the ever ineffective Mr. Hankins. I also, will not accept your removal of my services as a volunteer in Code Enforcement and review undue influence and lack of empowerment to do that. Let us remember that your onetime mentor, the fired for cause, Ms. Dolan, will not have the voice to constantly defend you, as she had to so often in the past. Sincerely, Steve Rivero-Lowen ~A Citizens Response to Councilman Ecton I responded to an interview with Councilman Wayne Ecton by Robert Leger of the Scottsdale Republic on Tuesday November 25th which can be found at: http://www.azcentral.com/members/Blog/SREditorials/39987 Mr. Ecton, Mayor-Elect Jim Lane is pragmatic, is thoughtful and is also candid and aware of the City as "a whole," not individual parts separate from one another, and he is aware of the need for sound long range planning inclusive of all community voices to build consensus. He knows, as do the people that none of us get 100% of our "vision," but we build that consensus with respect and open minds and hard work. Trust me Mr. Ecton, Mayor Manross was not intimidated by "activists" because she totally ignored their existence and their concerns. When the discussion has been inclusive and in depth contention will diminish, it might not go completely away. Hopefully those voices will remain to keep all on target. Please, Mr. Ecton, listen to your son more often. As to Dolan, you now admit that what the residents were saying all along, for over five years, was true. Yet, you strung the people along to accommodate the special interests and developers allowing project by project development and no long range planning and purposeful neglect for an implementation process for specific elements of the General Plan. Do you have ideas about what should happen on McDowell Road? I have some ideas about what I don't want…………………….Start paying attention right now to the "Advanced Planning" effort the South Scottsdale Community Planning Area is engaged in to address the mandated update to the General Plan. When you think about the location……think about the economic development of the McDowell/Scottsdale Road Corridors that connect them with neighboring communities along with the over 70,000 people living South of Indian Bend Road. When you think about Scottsdale, in total, think about the need for "essential worker housing" for all those who provide the quality of life we all enjoy 24/7. Remember that healthy communities provide many housing options for youth, senior citizens, owned and rented; and remember that all levels of income should be addressed with a vision for quality of life. Not all senior citizens can afford luxury accelerated communities, nor do they want them. Think mixed use to address the needs for economic development. Respect the integrity of existing single family neighborhoods when addressing infill projects and that includes the issues of height and density. It is amazing that one so close to all government functions can be so far off base about SkySong and South Scottsdale. Mr. Ecton, some of those dreaded activists you impunge spent some time with former Economic Developer David Roderique before he quit and asked what Scottsdale was doing to "officially" assist the developer of SkySong to promote that project and South Scottsdale as a good place to live and do business. They put the same question to the Executive Director of the Scottsdale Area Chamber of Commerce. They got the same answer from both gentlemen, "Nothing." When you have no long range planning process to implement the vision how and what do you promote? It was not because it is "South Scottsdale." It was because the City Manager, Mayor, Council and business leaders walked away thinking the name Michael Crow and ASU would seal the future. This is why programs such as ASU Institute for Global Sustainability are tackling the question, "What can be done to make SkySong successful. Every citizen in Scottsdale knows that the McDowell Sonoran Preserve must be completed and maintained both from an economic point and an environmental point. Council members and community have to create better partnerships to address the finances, whether that includes taxes or public-private partnerships. There isn’t one person on the Council presently, or recently elected, who is not intelligent and capable. The problem is that some refuse to be circumspect. One size does not fit all. If you choose to run for a third term consider the big picture of Scottsdale and what goes into managing the business of the 240,410 "shareholders" who live in it’s 184.2 square miles divided in to corporate subdivisions. Remember too, that around this wonderful world countries, cities, older than Scottsdale and bigger, have managed to respect and preserve their past while including the "new and vibrant." It can be done, it does take planning and vision "Dodie" ~ More Code Enforcement Problems!! Editors Note: The messages start at the bottom and chronologically progress from the bottom up. Why is it that issue after issue continually come up concerning the Code Enforcement Department problems? Could it be a personnel problem or a lack of training? We’re told that the department is under an extensive reorganization. We hope this is true and that certain employees are either demoted or replaced. ================================================== Editor, I realize you are no longer writing the weekly activist. Just wanted to pass this along and give yet another example of "do what I say not what I do" Scottsdale logic. Code enforcement is broken and no one seems to want to fix it.

Essentially he saying that someone complained about your min-storage units, and did not respond to whether the city complies itself. I presume that the city feels they can continue their use until someone complains. It is not a real good answer for you and it may not be entirely just, but that is the way they operate. The anonymous complaint is a poor method to use in the enforcement of code. It may deserve some review just because there is too much latitude (arbitrary judgment) with that type of selected enforcement. "Jim" Lane Councilman Lane: Yes, we do enforce the ordinance equally and generally speaking, it is done on a complaint basis. While the person did not include the address of the issue, I checked the Northsight area and found two open complaints regarding this issue. The first was the result of a e-mail compliant and the second was the result of the Inspector initiating a case for the adjacent property while investigating the first violation. We will investigate the locations listed in the below e-mail and if warranted, initiate a case. Please note that the Zoning Ordinance does allow for the temporary use (90 days) for this and we are working with the Planning dept. on potential longer term solutions as the desire to use mobile minis is becoming popular in both the Northsight and Airpark areas, as well as other parts of the City. In answer to a Scottsdale Republic column, "Old Pioneer" sent us the following: http://www.azcentral.com/members/Blog/RobertLeger/39879 Editor, Mary Manross went from being a respectful, friendly and open public servant to a self-centered, disrespectful, fierce and nasty mayor to many who tried to work with her including council members. She put on her designer blinders and swore irrationally, that she was carrying out former mayor Herb Drinkwater's work which is an ugly joke at best. In fact, she was systematically destroying Drinkwater’s dream, our wonderful city and reputation area by area. I strongly suggest that long time die hard Manross supporters dropped her like a hot potato this election for one or more of the following reasons. Los Arcos was the premiere commercial location in South Scottsdale to renew the area by building on the already excellent area sales tax revenue to create an area where the auto dealers and other businesses would have new traffic from which to draw. First we had the Coyotes Arena which the voters approved twice but lost due to Manross' inept abilities to understand the situation. (Or could it have been because of a pending special secret deal?) Then we had the WalMart offer which again would have brought needed blood and traffic to the area, even with the unpopular subsidy (which would have been paid back long ago), but no, she had already been secretly working with ASU/ASUF to give away the property, then paid twice the appraised value through what I feel was a prearranged shady deal with Crow and Ellman. What did we the taxpayers get? Nothing for almost 200 years; No tax revenue, no retail areas, and up to 800 apartments that were never part of the original plan, all to get a legacy for a greedy mayor who had totally lost sight of the needs of the city and her reason for being mayor. But guess what else? She and the council majority set up the city taxpayers to be totally responsible for the entire infrastructure within and around SkySong for the entire 198 year term of the leases. Because Manross effectively shot down the Coyotes Arena and the WalMart proposal in favor of a legacy instead of desperately needed taxes of any kind from ASU/ASUF SkySong, and paid ASU/ASUF and in turn Ellman twice what the land was worth by certified appraisal. The falsely inflated property value has caused potential and honest developers to loose their shirts because at those land prices, the developers cannot make the property pencil (be profitable) and so the area has fallen into disrepair. The formerly busy and sales tax rich "Motor Mile" and a once vibrant retail strip center and Bashas Market east of SkySong (Los Arcos Crossing) has disappeared because of Manross failing to understand anything about true property values, development and regeneration. Lowes and Big "O" Tires you say? She had absolutely nothing to do with either coming to that South Scottsdale location. Next, she allowed Rawhide, the remaining single largest sale tax provider and tourist attraction in the North East valley, to move to White Horse Pass on the Gila River Reservation while we had 80 acres next to West World (for which she paid 3 times the market value) where Rawhide could have fit nicely. What did we get in return? Another set of Condos with increased height and density that are or will be sitting half empty, with little to no retail sales tax revenue to be seen for the foreseeable future. Then we have her illegal and secret act of knowingly signing an illegal lease with the State Land Trust Department for 10 million dollars without the City Councils knowledge or approval which will cost taxpayers the 10 million plus legal fees. This was while the city was planning to bid on the properties but PUBLICLY limited the amount the city would pay for said property allowing another bidder to legally and openly beat the city's bid which was above board and fair by law. For someone who had already served over 14 years working within and knowing the city rules and Chart rules intimately, this was a selfish act of shear arrogance and stupidity based on her misguided thought that she was now invincible and could do as she pleased with total disregard for the citizens thoughts or needs. She still has to answer legally and be deposed for this illegal act, for which she can and should be convicted for malfeasance in office under city and state statutes. Downtown? Sure, now we have scores of empty bank owned condos, and 20-somethings openly urinating on the sidewalks, alleys and parking lots while families are steering away from the area after 5pm because of the drunks and unruly crowds, along with bars so thick and growing that we will never get downtown back to what it should be as far as our former reputation of a "family friendly" experience is concerned. Where were you Councilman Ecton? Property tax reduced? Come on people, get a grip on reality!! Mary Manross knew full well that in actuality, she was only telling the good half the story concerning property taxes when she knew full well that because of the huge increase in property values, the property tax ratio would be dropped yet the actual tax to the property owners would escalate by double digits for a number of years. This just barely scratches the surface of how Manross and her council majority cost herself and the city taxpayers so much money and the city’s reputation, along with her re-election. Jim Lane and the new City Council? They'll do very well if they understand and learn the lessons of a number of serious failures during the Mary Manross Administration. Any other questions? "Old Pioneer" Editors Note: Although Manross lost, the margin was very small. With that said, Manross used to have a guaranteed 8,000+ vote cushion plus whatever else she could pick up without help from developer or builder campaign donations which she promised many times to never use. This time she broke her promise and took developer and builder funds and still lost. Apparently her "edge" disappeared in this election because of the number of bad decisions she and the council majority made in the last few years. "Old Pioneer" has hit the nail on the head with this note concerning his/her reasons why Manross lost. ALL existing development on the southern side of E. Bell Rd complied with the 36 ft limit. · It is illogical to allow a highly-measurable increase in building heights next to land protected by the Environmentally Sensitive Land Ordinance. What environmental impact? · Why lose the view corridor (insufficient project setbacks as well as height increase requested) to our Sonoran Preserve gateway route and the future Desert Discovery Center? · Why award upzoning that improves property value for the developer without major city incentives? · Why are citizens attending the Greater Airpark Community Area Plan study sessions and forums while the Planning Commission and City Council continue to review and approve significant upzoning case-by-case? · The GACAP participants have strongly advocated that ONLY the airpark area be considered for high-rise buildings. It would give them "by right live entertainment as an ancillary use to hotels, motels and timeshare developments" according to the applicant. Current Zoning Ordinance J-10-b states "No external speakers will be permitted on the premises of a use permitted under this section, which is located within five hundred (500) feet of a residential district…." It is the understanding of impacted neighborhoods near the W Hotel, Waterfront and Southbridge areas, along Goldwater Blvd and near other bars/nightclubs with outdoor entertainment or doors open wide that if this is approved, those businesses will have the flexibility to conduct outdoor live music nightly because no Noise Ordinance exists in the city. If approved---this is CITY WIDE approval! Dan Stymer dstymer@scottsdaleaz.gov is the city staff member to contact with your questions. ~Outdoor Sales Display and Retailing 10-TA-2008 If approved, it would allow outdoor—sidewalk, parking lot, etc—display of merchandise and sales displays CITY WIDE. What an abrupt change to our strict sign and display existing code! This would loosen restrictions on ALL FORMS of commercial establishments that include C-S, Commercial 1-2-3-4, C-O, PNC, PCC, PRC, Downtown District and PCP. The Planning Commission hears it on January 14th and the City Council decides on February 10th. I paid for an annual subscription to the Trib which expires in March but they have already stopped delivery to my home. Others may find the same thing. One of our first acts in moving to Scottsdale in 1967 was to subscribe to the Progress. I can't help from feeling something missing from my mornings now. I know, I know, there's the Republic but I said "newspaper" not house organ rag for the Chamber. ~ Hey Activist, here’s something interesting. I live up north and see City of Scottsdale Inspection Service trucks all day long just roaming around with no real purpose or apparent property to inspect. Case in point: Sereno Canyon just at the end of Happy Valley East where it dead ends and then runs into 118th street. Today so far I've seen 6 different trucks just driving around then they pull off the side of the road, make some telephone calls, sit for 15, 20 or 30 minutes at a time then they'll leave and come back later. I know work is real slow for everyone but why aren't they trying to be more productive? It really irks me to hear that the city has such a budget deficient yet these guys still run around wasting time and money. Maybe someone needs to audit the department, especially Ralph Noriega’s portion. ~ Doesn't Manross know how to do anything but whine? Mary: HELLO, you lost because you did some really stupid stuff and deserve what you get for it. ~ So the developer of the Epicenter is demanding a reduction in the size of the Equestrian trails adjoining his property is he? Maybe we should mount him upon a horse, even a well mannered one, than ask him to turn the horse around in a walled 8 foot alley. God help him if something should spook any animal. This is all BS and needs to be stopped NOW. Mr. Spiro has been correct all along and no one in the city will listen to him. Maybe when this developer gets his way, someone will get hurt or killed and their family can sue the pants off both him and the city. ~ We were so sorry to hear that Brian Powell is no longer with the Scottsdale Tribune. He was one of the best and one of a very few who actually did some investigative reporting on the city government in Scottsdale. Ari Cohn is almost as good, but then they’ll all be gone in January anyway I guess. Too bad the Repugnant is such a rotten, lying rag. You can’t believe anything written in it because it is so slanted against the citizens. Oh well, at least the Scottsdale Activist is still available as are some other free papers and websites who cover or uncover other city issues. ~How great to see the Activist again this morning. We all need this kind of input. The one negative side is that you will still never get time to stop by for a Brew. Editors Note: Don’t bet on it!! With everything that’s still going wrong city-wise, I’ll most probably need at least one!! I just pray that the new council members are more informed and interested in what the CITIZENS think and want rather than what the developers or Chamber want. OMG!! The Dial building is bad enough and we still have "One Scottsdale" to be built. YUK!!! ~Beverly Lloyd Lee just thinks she has all the answers. She's really just full of herself but really doesn’t have a clue about the city growth, but LOVES Mary Manross. Doesn’t that give you a clue as to the motives behind her inane articles? Give it a break Beverly. How can an interior designer know anything about how to sensibly grow a city while maintaining its heritage? ~ YES!! Manross should be prosecuted, convicted and sentenced for malfeasance in office. Why should she walk away Scott-free when she cost many good employees their jobs and the taxpayers tens of millions in wasted dollars? ~ To whomever the YaHoo is in the North Scottsdale Carriage Hills Subdivision who is trying to change the NAOS and ESLO plant list; Give it a rest pal, we plan to fight you and the city all the way to the wall on this one. That ordinance was there when you bought your property and you damned well knew it. You won't roll over us on this one now!!! Build a bridge and get over it Palie Boy: NO changes will be tolerated by the residents who worked for decades to come up with this list. ~ Could it be that "Queen Mary" will pull a "Bill Clinton" and take all pertinent information from the city files and leave the New Mayor Jim Lane with nothing?
